The current limits on pay awards and penalties for getting it wrong as at 01 October 2009 are:

  • Limits on pay for award calculations
    1 week = 380 GBP with effect from 01 October 2009

  • Maximum basic award for unfair dismissal
    30 weeks' pay or 10,500 GBP

  • Maximum compensatory award for unfair dismissal
    66,200 GBP (uncapped for health & safety and whistle-blowing claims)

  • Minimum basic award for dismissal on trade union, health and safety, occupational pension trustee, employee representative or working time grounds
    4,700 GBP

  • Minimum award for employees excluded / expelled from trade union
    7,300 GBP

  • Maximum award in breach of contract cases
    25,000 GBP

  • Penalty for knowingly hiring illegal workers
    Imprisonment and unlimited fine

  • Penalty for unwittingly hiring illegal workers
    On the spot fine of up to 10,000 GBP
